[27\/28 juin 2024]"},"content":{"rendered":"\n<p><strong><u>Pr\u00e9sentation du projet<\/u><\/strong><\/p>\n\n\n\n<p>Le Centre de Recherche Juridique (CRJ) de l\u2019Universit\u00e9 Grenoble Alpes s\u2019int\u00e9resse depuis plusieurs ann\u00e9es au positionnement disciplinaire du droit \u00e9lectoral au sein des branches du savoir acad\u00e9mique et aux implications de ce positionnement sur ses m\u00e9thodes et sur ses r\u00e9sultats, tandis que le Centre d\u2019\u00e9tudes sur la S\u00e9curit\u00e9 Internationale et les Coop\u00e9rations europ\u00e9ennes (CESICE) se pr\u00e9occupe de longue date des conditions juridiques de la s\u00e9curit\u00e9 collective dans le monde. Ces deux laboratoires de l\u2019UGA ont d\u00e9cid\u00e9 d\u2019organiser un colloque les 27 et 28 juin 2024 sur un sujet d\u2019int\u00e9r\u00eat commun, l\u2019internationalisation du droit des \u00e9lections politiques. Ce projet s\u2019inscrit dans la lign\u00e9e d\u2019une s\u00e9rie d\u2019\u00e9v\u00e9nements organis\u00e9s \u00e0 Grenoble sur les interactions entre le droit des \u00e9lections politiques et d\u2019autres branches du droit (droit administratif et droit des \u00e9lections politiques, 2017&nbsp;; droit p\u00e9nal \u00e9lectoral, 2019&nbsp;; droit \u00e9lectoral et collectivit\u00e9s territoriales, 2020).<\/p>\n\n\n\n<p>Si l\u2019internationalisation du droit \u00e9lectoral n\u2019est pas un ph\u00e9nom\u00e8ne nouveau, plusieurs \u00e9v\u00e9nements r\u00e9cents ont particip\u00e9 \u00e0 mettre en exergue certains de ses enjeux. \u00c0 titre d\u2019exemple, la crise de la Covid a entra\u00een\u00e9 des effets sur de multiples processus \u00e9lectoraux de diff\u00e9rentes natures, r\u00e9v\u00e9lant ainsi de nouvelles manifestations de ce ph\u00e9nom\u00e8ne \u00e0 travers, notamment, la mobilisation de standards internationaux<a href=\"\/#_ftn1\">[1]<\/a>. Au-del\u00e0 de la crise de la Covid, l\u2019\u00e9volution de certains r\u00e9gimes vers des d\u00e9mocraties \u00ab&nbsp;illib\u00e9rales&nbsp;\u00bb ou des \u00ab&nbsp;d\u00e9mocratures&nbsp;\u00bb<a href=\"\/#_ftn2\">[2]<\/a>, montre \u00e0 la fois les enjeux et les limites du ph\u00e9nom\u00e8ne d\u2019internationalisation du droit \u00e9lectoral, notamment \u00e0 travers le contournement et la mobilisation politique des standards internationaux.<\/p>\n\n\n\n<p>De ce point de vue, la prise en consid\u00e9ration croissante de certaines normes d\u2019origine internationale (de <em>hard<\/em> comme de <em>soft law<\/em>) dans le d\u00e9veloppement du droit interne des \u00c9tats pourrait laisser penser qu\u2019il existe un v\u00e9ritable ph\u00e9nom\u00e8ne d\u2019internationalisation du droit \u00e9lectoral<a href=\"\/#_ftn3\">[3]<\/a>. Adoss\u00e9 au d\u00e9veloppement d\u2019un droit international de la d\u00e9mocratie \u2013 voire d\u2019un droit <em>\u00e0 <\/em>la d\u00e9mocratie \u2013<a href=\"\/#_ftn4\">[4]<\/a>, ce ph\u00e9nom\u00e8ne est toutefois loin d\u2019\u00eatre homog\u00e8ne car, l\u00e0 o\u00f9 les \u00c9tats en crise<a href=\"\/#_ftn5\">[5]<\/a> font l\u2019objet d\u2019assistance, de certification et d\u2019observation \u00e9lectorales accrues, les d\u00e9mocraties install\u00e9es semblent rester davantage \u00e0 l\u2019\u00e9cart de cette influence. L\u2019ambition du colloque est donc d\u2019envisager les diff\u00e9rents aspects de ce ph\u00e9nom\u00e8ne d\u2019internationalisation tout en mettant en lumi\u00e8re le caract\u00e8re variable de sa port\u00e9e. En effet, on observe simultan\u00e9ment un d\u00e9veloppement significatif de standards internationaux et une r\u00e9ticence, parfois exacerb\u00e9e, des \u00c9tats qui les d\u00e9veloppent \u00e0 s\u2019y voir soumis. Les organes d\u00e9veloppant des standards en la mati\u00e8re \u2013 OSCE, Commission de Venise du Conseil de l\u2019Europe, Union europ\u00e9enne, Union africaine, Commission interam\u00e9ricaine, organes onusiens par exemple \u2013 semblent ainsi trouver un public plus r\u00e9ceptif aupr\u00e8s des \u00c9tats en cours ou \u00e9mergent d\u2019une transition d\u00e9mocratique que les \u00ab&nbsp;vieilles d\u00e9mocraties&nbsp;\u00bb et les d\u00e9mocraties illib\u00e9rales. Certes, les \u00e9lections conformes aux standards internationaux ne sont qu\u2019une condition n\u00e9cessaire, et non suffisante, de la d\u00e9mocratie. Cela dit, se pose \u00e0 la fois la question \u00e0 la fois des origines de l\u2019internationalisation de son droit, celle de de ses moyens et de ses cons\u00e9quences.<\/p>\n\n\n\n<p>Les contributions propos\u00e9es peuvent porter sur diff\u00e9rents aspects de cette th\u00e9matique. De mani\u00e8re g\u00e9n\u00e9rale \u2013 et non exhaustive \u2013, elles peuvent traiter des formes, modalit\u00e9s et contenu du droit international ou r\u00e9gional des \u00e9lections politiques, des outils de cette internationalisation et de leur port\u00e9e. These two UGA research centers have decided to organize a colloquium on June 27 and 28, 2024 on a topic of common interest, the internationalization of political election law. This project is part of a series of events organized in Grenoble on the interactions between political election law and other branches of law (administrative law and political election law, 2017; electoral criminal law, 2019; electoral law and local authorities, 2020).<\/p>\n\n\n\n<p>While the internationalization of political election law is not a new phenomenon, a number of recent events have highlighted some of the issues at stake. The Covid crisis, for example, has had an impact on numerous electoral processes of various kinds, revealing new manifestations of this phenomenon, in particular through the mobilization of international standards<a href=\"\/#_ftn6\">[6]<\/a>. Beyond the Covid crisis, the evolution of certain regimes towards \u00ab\u00a0illiberal\u00a0\u00bb democracies or \u00ab\u00a0democratures\u00a0\u00bb<a href=\"\/#_ftn7\">[7]<\/a> demonstrates the stakes and the limits of the phenomenon of internationalization of electoral law, both by bypassing and manipulating of international standards.&nbsp;<\/p>\n\n\n\n<p>From this point of view, the increasing consideration given to certain norms of international origin (both hard and soft law) in the development of the domestic law of States could suggest the existence of a genuine phenomenon of internationalization of electoral law<a href=\"\/#_ftn8\">[8]<\/a>. Backed by the development of an international law of democracy &#8211; or even a right to democracy &#8211;<a href=\"\/#_ftn9\">[9]<\/a>, this phenomenon is far from homogeneous. Indeed, while states in crisis<a href=\"\/#_ftn10\">[10]<\/a> are subject to increased electoral assistance, certification, and observation, established democracies and democracies leaning towards illiberal regimes seem to remain more aloof from this influence. The aim of the symposium is therefore to consider the various aspects of this phenomenon of internationalization, while highlighting the variable nature of its scope. At one and the same time, there is a significant development of international standards and a reluctance sometimes exacerbated to be bound by them on the part of the States developing them. Bodies developing standards in this field &#8211; such as the OSCE, the Council of Europe&rsquo;s Venice Commission, the European Union, the African Union, the Inter-American Commission and UN bodies &#8211; seem to find a more receptive audience among states in the process of democratization than \u00ab\u00a0old democracies\u00a0\u00bb and illiberal democracies. Over and above the relevance of the procedural character of democracy as defined by these institutions, the question arises as to the origins of the internationalization of its law, its means, and its consequences.<\/p>\n\n\n\n<p>Contributions may address different aspects of this thematic. Generally speaking &#8211; and this is not an exhaustive list &#8211; they may deal with the forms, modalities, and content of international or regional law on political elections, the tools and scope of this internationalization.
